Olmstead Plan Information
In June 1999 the U.S. Supreme Court ruled in the case of Olmstead v L.C. that it is a violation of civil rights under the Americans with Disabilities Act to require disabled individuals to be institutionalized or remain institutionalized and to prevent their transition to mainstream life when: 1) the treating professionals determine treatment can be provided in a community setting; and 2) the individuals do not object to the transition.
Although the court decision does not require states to provide unlimited options and services, the clear intent is to uphold and enforce ADA provisions by providing careful case review to determine the most appropriate treatment environment and to offer individuals the least restrictive and most integrated community-based services appropriate.
