The Division of Administrative Hearings provides impartial hearing officers for administrative hearings to resolve disputes concerning benefits, services and actions in a variety of programs administered by the Cabinet for Health and Family Services and governed by state and federal law.

The Division of Administrative Hearings has two branches:

  • Families and Children Administrative Hearings Branch (FCAHB)
  • Health Services Administrative Hearings Branch (HSAHB)

The CHFS Families and Children Administrative Hearings Branch schedules administrative hearings conducted by hearing officers in many diverse programs and services provided participants by CHFS Department for Community Based Services divisions of family support, protection and permanency and child care and the Department for Income Support Division of Child Support, Kentucky Health Benefit Exchange and the Department for Aging and Independent Living.

Branch Functions

Hearing Officers conduct hearings scheduled as the result of appeals requested by program participants after unresolved questions involving program services and administrative actions involving recipient eligibility for programs such as:

  • Kentucky Transitional Assistance Program (K-TAP) including initial and ongoing eligibility for monthly payments, eligibility as an incapacitated individual, non-participation in the Kentucky Works Program (KWP) and concerning other services provided by the Department for Community Based Services.
  • Supplemental Nutrition Assistance Program (SNAP – former Food Stamp Program) including initial and ongoing eligibility for program benefits, participation in the employment and training program and recoupment of overpayment of benefits. Conducts hearings for individuals the agency suspects committed an intentional Program violation.
  • Child Care Assistance Program (CCAP), including recoupment of overpayment of benefits and hearings for individuals the agency suspects committed an intentional Program violation.
  • Kentucky’s Health Benefit Exchange.
  • Medicaid including initial and ongoing eligibility for medical benefits, eligibility as a permanent and totally disabled individual and monthly personal obligation for cost of nursing facility care.
  • Division of Child Support Enforcement including obligation amounts, tax intercept, payment arrearages and suspension of drivers licenses.
  • Division of Protection and Permanency including program issues about services for and treatment of families and children.

The CHFS Health Services Administrative Hearings Branch hearing officers conduct hearings and render findings of fact, conclusions of law and recommended orders or final decisions on matters involving the Office of Certificate of Need; Office of Inspector General; Department for Medicaid Services; Department for Public Health; the Department for Mental Health, Developmental Disabilities and Addiction Services; Department for Aging and Independent Living; Department for Family Resource Center and Volunteer Services; and the Department for Community Based Services (specifically hearings requested in response to CHFS investigation of substantiated findings a person perpetrated abuse or neglect of a child or adult).

  • Long-Term Care Citations and Penalties
  • Involuntary Transfer and Discharge
  • Utilization Review (Private Review Agents) Denial or Revocation Hearing Procedure
  • Dispute Resolution Procedure between Private Review Agents and Health Care Providers and Patients
  • Nurse Aide Abuse, Neglect and Misappropriation
  • Child Care Facility Licensure
  • Certification of Family Child Care Homes
  • Medicaid Reimbursement: Ancillary Therapy and Oxygen Services in Nursing Facilities  
  • Medicaid Reimbursement: Payments for Nursing Facility and Intermediate Care Facility for  the Mentally Retarded Services
  • Medicaid: Conditions of Medicaid Provider Participation, Withholding, Overpayments
  • Medicaid Covered Services (recipient or applicant appeals)
  • Maternal and Child Health (WIC)
    Disciplinary Appeals Process for Local Health Department Employees
  • Food and Cosmetics
  • Milk and Milk Products
  • Substance Abuse
  • On-Site Sewage Disposal System Installer Appeals
